Terms of Service

These Terms of Service ("Terms") govern your use of hosting services, including dedicated servers, colocation, cloud, and other related services ("Services") provided by MinRTT Inc, a company based in Austin, Texas ("we," "us," or "our"). Legal address: 14425 Falcon Head Blvd BUILDING E, Suite 100, Austin, TX 78738. By accessing or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Services

We provide hosting services, including dedicated servers, colocation, cloud, and other related services, including hardware, bandwidth, and basic support where applicable. Servers and resources are self-managed by the customer unless otherwise specified. Basic support includes hardware repairs at no extra cost for dedicated servers; additional support services (e.g., software configuration, troubleshooting) may be billed at our standard rates. Services are "as is" and subject to availability. We may modify Services with notice. Services are provisioned automatically upon payment where applicable. Once activated, Services are generally non-refundable due to resource allocation, except as provided under our 3-3-3 Guarantee below. RAID configurations, if provided, are for redundancy and performance but are not a substitute for backups. You are solely responsible for maintaining your own backups of data stored on the servers or resources.

2. User Responsibilities

  • You must be 18+ and provide accurate information.
  • Comply with all laws, including U.S. federal and Texas state laws.
  • Pay fees on time via credit card or bank transfer.
  • Maintain security of your account and servers/resources.
  • Contact our support team for any issues before initiating a chargeback or dispute with your payment provider.
  • Maintain your own backups; we do not provide backup services, and data loss may occur due to hardware failure, termination, or other reasons.

3. Prohibited Activities

You may not use Services for:

  • Spam, unsolicited emails, or phishing.
  • Illegal activities, including child exploitation, terrorism, or distribution of controlled substances.
  • Hacking, DDoS, malware, or unauthorized access.
  • Infringing intellectual property.
  • Overloading infrastructure or disrupting critical sectors (e.g., healthcare, power grids).
  • Any abuse that harms our network or other users.

We collect and analyze network traffic flow metadata (connection information such as source and destination addresses, ports, protocols, and data volumes) to protect the network and detect abuse such as spam, denial-of-service attacks, and port scanning. This is metadata only: we do not inspect the contents of your traffic. We may suspend or terminate Services for violations of this section.

4. Payments and Refunds

Fees are monthly and non-refundable, except as guaranteed by our 3-3-3 Guarantee (when not abused). We process payments via Stripe. You authorize recurring charges and agree that all sales are final upon service activation. Late payments incur 1.5% interest. We may adjust prices with 90 days' notice.

Promotional and Signup Credits: Account credits issued for promotional purposes, including signup bonuses, referral and invite bonuses, phone verification bonuses, and trial credits, are provided at our sole discretion, have no cash value, and are non-refundable and non-transferable. We may reduce or remove any such promotional credit from an account if it has not been applied to a paid service within 30 days of being credited to the account. This does not affect credit representing funds you have actually paid to us.

Coupon Codes: Unless we expressly agree otherwise in advance, coupon and discount code usage is limited to one coupon use per customer/account in total, across all coupon codes, and coupons may not be combined with other coupons or promotions. If you would like to use more than one coupon, or use a coupon more than once, contact us before placing your order; approval is at our sole discretion. If coupons are used beyond this limit, or otherwise outside their intended terms, without our prior agreement, we may reverse the discount and bill the affected services at their regular price, or cancel the affected orders. Coupons have no cash value and may be modified or withdrawn at any time. Where a server order uses a setup-fee option to lower its monthly rate, that order is not eligible for any coupon or discount code.

3-3-3 Guarantee:

Scope: The 3-3-3 Guarantee applies exclusively to dedicated server orders. Colocation services (per-U and full rack), cross-connects, custom bandwidth arrangements, cloud services, and other non-dedicated-server products are not eligible for the 3-3-3 Guarantee. Refund, price-lock, and advance-notice terms for those products are governed by their individual service agreements.

  • 3-Day Money Back Guarantee: You may request a full refund within 3 days of initial payment and service provisioning. This is limited to three refunds per customer/account to prevent abuse (e.g., repeated sign-ups and cancellations). Refunds are not available if the service has been used for prohibited activities, generated significant traffic (>1 TB), or if we detect patterns of cycling abuse. Requests must be submitted by canceling the service at the bottom of the relevant service page and are subject to review; we reserve the right to deny if abuse is suspected.
  • 3-Year Price Lock: Your initial monthly fee is locked for 3 years from sign-up, subject to compliance with these Terms.
  • 3-Month Advance Notice of Price Changes: Any price adjustments after the lock period will be notified at least 90 days in advance.

The 3-Day Money Back Guarantee applies only to dedicated servers that are available for instant deployment from our existing inventory. Orders that include servers requiring custom configuration (indicated as "Next Business Day" delivery during checkout) are not eligible for the 3-Day Money Back Guarantee. The 3-Year Price Lock and 3-Month Advance Notice of Price Changes remain in effect for all dedicated server orders.

You agree not to dispute charges without first attempting resolution through our support, and improper chargebacks may result in account suspension, additional fees, and collection actions.

5. Chargeback Disputes

By using our Services, you agree to resolve any billing disputes directly with us before filing a chargeback with your credit card issuer or payment processor. You acknowledge that we provide evidence of service delivery (e.g., access logs, provisioning timestamps) to defend against disputes. Filing a chargeback without prior contact may be considered a breach of these Terms, leading to immediate termination and liability for any costs we incur (e.g., chargeback fees from Stripe). We reserve the right to contest all chargebacks and provide documentation showing your acceptance of these Terms and receipt of Services.

6. Termination

  • For services ordered via the control panel, you may cancel at any time during the active term within the control panel.
  • For colocation and custom solutions, cancellation requires notice as defined in your contract, or 60 days if not defined in the contract.
  • We may terminate for breach, non-payment, or legal reasons without notice.
  • Upon termination, data may be deleted; back up your content.

7. Limitation of Liability

We are not liable for indirect damages, data loss, or downtime. Liability is limited to fees paid for the current service period. Network uptime is governed by our Service Level Agreement, which sets out service credits as the sole and exclusive remedy for any SLA failure.

8. Indemnification

You indemnify us against claims from your use of Services, including any chargeback-related disputes.

9. Changes

We may update Terms with notice. Continued use constitutes acceptance.

10. Remote Hands (Colocation)

Remote hands covers physical and hands-on work we perform on your behalf on customer-owned equipment in our colocation facilities, requested through our support system. Remote hands rates and any included allowances are governed by your individual colocation service agreement. Where your agreement does not specify, the following default rates apply:

  • Scheduled Remote Hands — $75 per hour. Non-urgent work performed at a time mutually agreed between you and us, based on our best availability.
  • Emergency Remote Hands — $350 per hour. Urgent work that you request be started as soon as possible. We guarantee to begin such work within six (6) hours of the request, and typically begin sooner, usually within two (2) hours.

Both scheduled and emergency remote hands are billed with a one (1) hour minimum for the first hour, and in thirty (30) minute increments thereafter. Time is measured from when our technician begins work on your request until the work is complete, including any diagnosis, coordination, and testing.

11. Cabinet Rekeying and Unescorted Access (Colocation)

Full-cabinet colocation cabinets are provided locked and are ordinarily accessed through our on-site staff under the remote hands terms above. If a client requires their own unescorted physical access to their cabinet, the cabinet lock must be rekeyed and a dedicated key issued to the client. At our discretion, we may instead install a combination lock and provide the client with the combination in place of a physical rekey and key. Any individual the client designates for unescorted cabinet access must first clear a background check, billed at cost. All costs incurred to provide this access are passed through to the client, including third-party locksmith charges to rekey the cabinet and the on-site escort time required to coordinate the locksmith, billed at facility escort rates.

Where a client instead prefers that their own personnel perform work in the cabinet under escort, or where escorted access is otherwise required, a member of our staff accompanies that person for the duration of their time on site. Escort time is billed at our remote hands rates under Section 10: scheduled rates where the visit is arranged in advance for a mutually agreed time, and emergency rates where access is requested on an urgent or short-notice basis, subject to the same minimums and increments. Any individual entering our facilities on a client's behalf, whether escorted or unescorted, must present valid government-issued photo identification and satisfy all facility access requirements, and we may require their identification and details in advance.

12. Equipment Shipping and Dock Access (Colocation)

All customer equipment entering or leaving our colocation facilities must be received and released through the facility loading dock, including equipment a client or their representative hand-carries. The facility does not permit equipment to move in or out by any other route. Before any delivery or pickup, a ticket must be submitted so we can coordinate dock access with the facility in advance: an inbound shipping ticket for equipment being delivered, or a support ticket for equipment being removed. Each ticket must list the items and quantities being shipped in or out. Equipment that arrives at the dock without a ticket submitted beforehand, or that does not match the items and quantities listed, may be refused or delayed by the facility.

13. Free Evaluation and Promotional-Credit Accounts

We offer promotional credit, such as a signup bonus for verifying your phone number, so you can try our Services with no upfront payment and no card required. We are glad to let you evaluate a real server this way.

While an account has only ever been funded by promotional credit that we issued, and has not yet been paid for with real funds, the Services on that account are provided on an as-is, best-effort basis. For those Services there is no Service Level Agreement, no service credits, and no warranties, and our total liability for them is limited to zero dollars. Because these Services are complimentary, we do not guarantee their availability and may suspend, terminate, or reclaim the underlying hardware at any time, including to make it available to a paying customer, with little or no notice.

You can move to full paid Service at any time. Simply prepay for the next service period using a payment of real funds, and from that point the standard terms of this agreement apply to your Service in full, including the Service Level Agreement, warranties, and the availability and notice protections that come with paid Service.

Nothing in this section limits our rights under Section 3 or our right to recover any amounts owed. "Promotional credit" means credit we issue at no charge, such as bonuses and courtesy credits, and does not include funds a client has added or prepaid.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Travis County, Austin, Texas.
